1. Acceptance of Terms

By creating an account or using Fynli, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

2. Description of Service

Fynli is a cash flow forecasting and financial analysis platform that integrates with Xero accounting software to provide insights into your business's future financial position. Our service includes:

  • Cash flow forecasting and visualization
  • Scenario modeling and analysis
  • Automated alerts and notifications
  • Financial reporting and insights

3. User Accounts

To use Fynli, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Providing accurate and current information

4. Acceptable Use

You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Violate any laws or regulations
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Transmit viruses, malware, or harmful code
  • Reverse engineer or attempt to extract source code
  • Use the service to compete with or harm Fynli

5. Subscription and Billing

Free Trial

We offer a 14-day free trial. No payment information is required to start your trial. At the end of the trial period, you must subscribe to continue using the service.

Paid Subscriptions

Paid subscriptions are billed on a recurring basis. By subscribing, you agree to:

  • Pay all fees associated with your chosen plan
  • Automatic renewal of your subscription unless cancelled
  • Price changes with 30 days' notice
  • No refunds for partial subscription periods

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of your current billing period. You will retain access until that time.

6. Intellectual Property

The Fynli service, including all content, features, and functionality, is owned by Fynli and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of your financial data, but grant us a license to process it to provide our services.

7. Data and Privacy

Your use of Fynli is also governed by our Privacy Policy. We collect and process your financial data solely to provide our forecasting services. We implement industry-standard security measures to protect your information.

8. Third-Party Integrations

Fynli integrates with Xero and other third-party services. Your use of these integrations is subject to their respective terms of service. We are not responsible for third-party services or any issues arising from their use.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FYNLI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. FORECASTS AND FINANCIAL PROJECTIONS ARE ESTIMATES ONLY AND SHOULD NOT BE RELIED UPON AS FINANCIAL ADVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYNLI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FYNLI IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Fynli from any claims, damages, losses, liabilities, and expenses arising from your use of the service, your violation of these Terms, or your violation of any rights of another party.

12. Dispute Resolution

Any disputes arising from these Terms or your use of Fynli shall be resolved through binding arbitration in accordance with the laws of [Your Jurisdiction]. You waive your right to participate in class action lawsuits.

13. Termination

We may terminate or suspend your account and access to the service at any time, with or without cause, with or without notice. Upon termination, your right to use the service will immediately cease, and we may delete your account and data.
